The Notion of Capacity for Therapeutic Decision-Making

The notion of capacity for therapeutic decision-making is indispensable for theory and practice of patient autonomy. The paper presents different approaches to this issue in law, philosophy and medical science and points to directions of future development and integration between those disciplines. Existing conceptual analyses, empirical science and jurisprudence from different countries requires further coordination and development of new concept of capacity in agreement with data from modern cognitive science.
